1. Scope
1.1 These Terms and Conditions of Alpinique Organics (hereinafter "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding goods and/or services offered in the Seller’s online shop. Any Customer terms are expressly excluded unless otherwise agreed.
1.2 For contracts concerning the delivery of vouchers, these Terms and Conditions apply accordingly, unless explicitly stated otherwise.
1.3 A consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for a purpose that is not attributable to their commercial or independent professional activity. An entrepreneur within the meaning of these Terms and Conditions is any natural or legal person or a legally capable partnership acting in the exercise of their independent professional or commercial activity when concluding a legal transaction.
2. Conclusion of Contract
2.1 Product descriptions in the Seller’s online shop are not binding offers; they serve to allow the Customer to submit a binding offer.
2.2 The Customer can submit the offer via the online order form integrated into the Seller’s online shop. By entering their personal data and clicking the button to complete the order, the Customer submits a legally binding offer regarding the goods and/or services in the shopping cart.
2.3 The Seller may accept the Customer’s offer within five days by:

sending a written order confirmation or confirmation in text form (fax or email) to the Customer, where the receipt of the confirmation by the Customer is decisive, or
-
delivering the ordered goods to the Customer, where the receipt of the goods by the Customer is decisive, or
-
requesting the Customer to pay after placing the order.
If multiple of the above options occur, the contract is concluded at the time the first option takes effect. If the Seller does not accept the offer within the period, this is deemed a rejection, and the Customer is no longer bound by their declaration of intent.
2.4 If the Customer chooses "PayPal Express" as the payment method during checkout, by clicking the button to complete the order, they simultaneously issue a payment order to their payment provider. In this case, the Seller hereby declares acceptance of the Customer’s offer at the moment the payment process is triggered.
2.5 The acceptance period starts the day after the Customer submits the offer and ends at the end of the fifth day following submission.
2.6 When submitting an offer via the online order form, the contract text is stored by the Seller and sent to the Customer via email together with these Terms and Conditions. Additionally, the contract text is archived on the Seller’s website and can be accessed by the Customer through their password-protected account, provided the Customer created an account before submitting the order.
2.7 Before submitting the order, the Customer can correct their entries using standard keyboard and mouse functions. All entries are displayed again in a confirmation window for final review and correction.
2.8 The contract language is German.
2.9 Order processing and contact take place via email and automated systems. The Customer must ensure the provided email address is correct so that all emails from the Seller or third parties commissioned by the Seller are received. Customers using spam filters must ensure delivery of these emails.
3. Prices and Payment Terms
3.1 All prices include statutory VAT and other price components. Additional shipping and delivery costs, if any, are listed separately in the product description.
3.2 Customers can choose from the payment methods displayed in the online shop.
3.3 If prepayment is agreed upon, payment is due immediately after conclusion of the contract.
3.4 If the Customer selects "PayPal," payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., under the PayPal terms: https://www.paypal.com/ch/webapps/mpp/ua/useragreement-full?locale.x=de_CH. A PayPal account must be opened or already exist.
4. Delivery and Shipping
4.1 Delivery is generally by shipping to the address provided by the Customer. For PayPal payments, the delivery address registered with PayPal at the time of payment is binding.
4.2 If the shipment is returned because delivery was not possible, the Customer bears the cost.
4.3 Risk of accidental loss or deterioration of the goods passes to the Customer upon dispatch or handover to the carrier.
4.4 Self-collection is not possible for logistical reasons.
5. Liability for Defects
Statutory liability applies.
6. Redemption of Promotional Vouchers
6.1 Promotional vouchers issued free of charge by the Seller within campaigns (hereinafter "Promotional Vouchers") can only be redeemed in the Seller’s online shop and only during the specified period.
6.2 Promotional vouchers can only be redeemed by consumers.
6.3 Certain products may be excluded if specified in the voucher.
6.4 Vouchers must be redeemed before completing the order. No retroactive credit.
6.5 Only one voucher per order can be used.
6.6 The order value must at least equal the voucher value. Remaining balances are not refunded.
6.7 If the voucher value is insufficient, other payment methods can cover the difference.
6.8 Voucher balances are not paid out in cash or interest-bearing.
6.9 Vouchers are not refunded if the goods paid with the voucher are returned under the right of withdrawal, if applicable.
6.10 Promotional vouchers are personal and non-transferable. The Seller may check entitlement but is not obliged.
7. Redemption of Gift Vouchers
7.1 Gift vouchers purchased in the online shop (hereinafter "Gift Vouchers") can only be redeemed in the online shop unless otherwise stated.
7.2 Valid until the end of the third year after purchase. Remaining balances are credited until expiry.
7.3 Must be redeemed before order completion. No retroactive credit.
7.4 Only one voucher per order can be redeemed.
7.5 Only for goods, not for purchasing other vouchers.
7.6 If insufficient, other payment methods can cover the difference.
7.7 No cash payout or interest.
7.8 Transferable. Seller may rely on holder’s entitlement unless aware of misuse or incapacity.
8. Applicable Law & Jurisdiction
8.1 Consumers: Swiss law applies. Exclusive jurisdiction is the Customer’s residence.
8.2 Entrepreneurs: Swiss law applies. Exclusive jurisdiction is the Seller’s office.
